Requirements For Use
Every customer must be at least eighteen (18) years of age in order to conduct business with AMERICAN PRECIOUS METAL BUYERS. In addition, every customer must be the actual owner of any and all property sold or attempted to be sold to AMERICAN PRECIOUS METAL BUYERS, and every customer must be acting on his or her own behalf and not as the agent or representative of another person. AMERICAN PRECIOUS METAL BUYERS may, but shall not be obligated or required to, request documentation or other proof of compliance with the requirements contained in this paragraph.
Verbal Offers
Any customer or prospective seller may request AMERICAN PRECIOUS METAL BUYERS to provide a telephone or e-mail quote for his or her items after such items have arrived at AMERICAN PRECIOUS METAL BUYERS processing facility. Verbal offers may, at the discretion of AMERICAN PRECIOUS METAL BUYERS, be recorded. Upon a verbal acceptance by the customer of the telephone or e-mail quote, payment will be issued by AMERICAN PRECIOUS METAL BUYERS within twenty-four (24) hours of such acceptance, and the seven (7) day customer satisfaction holding period guaranty will no longer be applicable to such transaction.
Guarantee Against Loss
AMERICAN PRECIOUS METAL BUYERS will guaranty against loss of the total contents which are shipped to us. AMERICAN PRECIOUS METAL BUYERS' liability will be limited to five-hundred ($500.00) dollars or the value of the contents, whichever is less, provided there is an original sales slip or appraisal. If there is no original sales slip or appraisal, AMERICAN PRECIOUS METAL BUYERS' liability is limited to one-hundred ($100.00) dollars. If there is an original sales slip or appraisal, AMERICAN PRECIOUS METAL BUYERS' liability will be limited to five-hundred ($500.00) dollars as set forth herein above. This Guaranty shall apply only to merchandise which is shipped with one of the carriers that is used by AMERICAN PRECIOUS METAL BUYERS.
This limitation of liability shall be binding on the customer/seller and any third party, including, but not limited to, customer's/seller's successors, insurance carriers, and any other individual or entity asserting any right or claim relating to this transaction.
In no event shall AMERICAN PRECIOUS METAL BUYERS be liable to any third party, including any insurance carrier. AMERICAN PRECIOUS METAL BUYERS shall not be liable for any subrogation claim brought by customer's/seller's insurance carrier and, by submitting an item to AMERICAN PRECIOUS METAL BUYERS, customer/seller expressly and specifically waives any such subrogation claim on his or her behalf, as well as on the behalf of his or her insurance carrier.
AMERICAN PRECIOUS METAL BUYERS shall not be liable to anyone for any damages, including, but not limited to, incidental, consequential, punitive, loss of profit or opportunity, other than as set forth herein above.
By submitting the item, customer/seller explicitly accepts this limitation of liability.
Return Insurance Liabilities
Parties offering merchandise for sale to AMERICAN PRECIOUS METAL BUYERS understand and accept that they will be offered the fair market wholesale value. If an item is returned to a seller, AMERICAN PRECIOUS METAL BUYERS will insure the item for no more than the amount offered by AMERICAN PRECIOUS METAL BUYERS, regardless of what it was insured for inbound by the seller, unless otherwise notified upon rejection of offer by email prior to return shipment.
AMERICAN PRECIOUS METAL BUYERS shall, in its sole discretion, choose the return carrier, insurance, and receipt verification method for each transaction.
Agreement To Indemnify americanpreciousmetalbuyers.com For Using This Website By using AMERICAN PRECIOUS METAL BUYERS, Inc., you agree to hold harmless americanpreciousmetalbuyers.com, its directors, officers, agents, and employees, from and against any and all claims, costs, expenses, and damages (including attorney's fees) arising out of or related to your access to this website.
Disputes and Applicable Law
AMERICAN PRECIOUS METAL BUYERS SHALL NOT BE LIABLE TO ANY PERSON FOR ANY DAMAGES WHATSOEVER, INCLUDING, WITHOUT LIMITATION, ANY DIRECT, INDIRECT, CONSEQUENTIAL, COMPENSATORY, PUNITIVE, BUSINESS LOSS OR INTERRUPTION DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE MATERIALS AND INFORMATION IN THIS WEBSITE. THIS PROVISION APPLIES EVEN IF AMERICAN PRECIOUS METAL BUYERS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Any dispute arising out of or relating to your use of this website shall be conclusively resolved by arbitration in the State of Florida, under the commercial arbitration rules of the American Arbitration Association then existing, and any judgment on the arbitration award may be entered in any court having jurisdiction over the subject matter of the controversy. The law of the State of Florida, U.S.A., without regard to its conflict of law rules, shall govern the resolution of any dispute relating to or arising out of your use of this website.
